Terms of use — Nibblist

These terms cover your use of Nibblist ("the app"), published by Escape Plan Software Ltd ("we", "us"), company number 17262078, registered in England and Wales. By downloading or using the app, you agree to these terms and to Apple's standard end-user license agreement below.
License
Your use of Nibblist is governed by Apple's Standard End User License Agreement (EULA), which you can read at apple.com/legal/internet-services/itunes/dev/stdeula. Where these terms and the Apple EULA conflict on a point the EULA covers, the Apple EULA governs.
What Nibblist is, and is not
Nibblist is a log and a checklist. It is not medical, nutritional or feeding advice.
- Nibblist does not tell you what to offer your child, when, how, how much or how often. It gives no serving, preparation, age, portion or choking guidance, and no meal plans.
- The built-in list of 100 everyday foods is a checklist, not a recommendation or a plan. It leaves out honey and the drinks, fish and foods the U.S. Centers for Disease Control and Prevention (CDC) lists to avoid or limit for babies and toddlers, but being on the list does not mean a food is suitable for your child. You can hide foods and add your own.
- Allergen tags mark foods that are, or by definition contain, an allergen on the list you use: the 9 major food allergens (milk, egg, fish, crustacean shellfish, tree nuts, peanuts, wheat, soy and sesame) published by the U.S. Food and Drug Administration, the NHS's list of 12, or the 14 of UK and EU food law. Packaged foods can contain other allergens; always read the label. The app counts what you log and shows the days since the last tasting you logged. It does not say whether that is enough, too little or too much.
- Reaction notes and tags are yours. The app stores and shows them; it does not interpret them, and a note or tag in the app is not a diagnosis.
- Reminders are only the ones you set, for the day and time you choose or after the number of days without a tasting you choose. They may not arrive if notifications are off, the device is off, or iOS delays them; don't rely on them for anything important.
- Always follow the advice of your child's doctor or health visitor about starting solid foods and allergens. If you think your child is having a serious allergic reaction or is in danger, call your local emergency number now.
- Links to official health organisations are provided for your information. We don't control their content.
Your data and backups
- Your log lives only on your device. We have no copy and cannot recover it for you. Use Share → Back Up Now to keep a backup file somewhere safe (for example Files or iCloud Drive), especially before changing phones.
- Your log stays on your device whether or not you subscribe, and you can export or delete it at any time.
- Reports you share (PDF, CSV) contain what you logged. You decide who receives them.
- A tastings file you send (Send Tastings) contains every child's tastings on your iPhone, without photos; the line under the button names the children. You decide who receives it.
Subscriptions
- What's on offer: Nibblist's log is unlocked by an auto-renewing subscription, either yearly or monthly. Before you subscribe you can tick the foods your child has already tried and see your progress, free. Current prices and any free trial are shown on the purchase screen inside the app and on the App Store before you buy. That is the source of truth, not this page, because Apple localizes and may update pricing.
- Free trial: Eligible new subscribers to the yearly plan get a 7-day free trial. Before you confirm, the purchase screen shows the trial on a timeline (today free for 7 days, the yearly price on day 7) and says under the button what you will be charged and how to stop it (for example, "Then $59.99/year, renewing unless you cancel in iPhone Settings at least 24 hours before the trial ends."). If you cancel at least 24 hours before the trial ends, you are not charged. The monthly plan has no trial.
- Auto-renewal: Subscriptions renew automatically for the same length and price shown at purchase, unless canceled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the current period ends.
- Cancellation: You can cancel any time in your device's Settings → [your name] → Subscriptions, or from Nibblist's Settings → Manage Subscription. Canceling stops future renewals; you keep access until the end of the period you already paid for. We cannot cancel a subscription on your behalf, because Apple manages billing.
- Refunds: All purchases are billed by Apple, so refunds are decided by Apple: request one from Nibblist's Settings → Request a Refund (shown while a purchase you paid for is active) or at reportaproblem.apple.com. If Apple declines a refund and you believe that is wrong, write to support@escapeplan.software and we will look into it.
- Price changes: If we ever change the price, Apple notifies existing subscribers in advance, and asks for your agreement where the rules require it. You can cancel before the new price applies.
Acceptable use
Nibblist is for your personal and family use. Please do not copy, resell or redistribute the app, or reverse engineer it except where the law allows you to.
No warranty
The app is provided "as is". We work to keep it reliable and to fix reported bugs, but we do not promise it will be error-free or available without interruption, to the extent permitted by law.
Liability
Our liability to you is as set out in Apple's Standard EULA. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you have legal rights in relation to digital content that is faulty or not as described; nothing in these terms affects those rights.
Governing law
These terms are governed by the law of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer-protection rights you have in your state or country of residence.
Changes
We may update these terms as the app changes. The current version is always the one published at this address, and material changes will be flagged inside the app.
